Todd J.W. Wisner also graduated from McQuaid Jesuit High School and Denison University.  He then worked in the litigation department at Squadron, Ellenoff, Pleasant & Lehrer (now Hogan & Hartson LLP) in New York City for senior partner Elliott Sagor and former SEC Chair Ira Lee Sorkin.  He then worked in the litigation department at Silver, Golub & Teitell for senior partner Richard Silver on medical malpractice cases in Stamford, Connecticut. 

He graduated from Thomas M. Cooley Law School in 1992 and joined the litigation department of Trevett, Lenweaver & Salzer, P.C., in Rochester, New York.  He worked under senior partner Thomas Trevett, and Thomas Van Strydonck, in the areas of commercial litigation and criminal defense.

For fourteen years Todd J.W. Wisner has successfully represented those accused of Alcohol Influenced Operating Offenses.  He began in 1992, when Mr. Wisner wrote a winning brief on a suppression issue in a DWI case. 

In 1994 Mr. Wisner founded the Wisner Law Firm, P.C. (now Wisner & Wisner, LLP,) concentrating in DWI defense.  Since that year he has represented hundreds of DWI clients as the practice became limited to DWI defense, Vehicular Crimes, and Appellate Advocacy.  He is admitted in New York and Connecticut, and represents clients all over New York State.

In 1996 Mr. Wisner founded DWILAW.COM to provide basic information to those charged with an alcohol influenced operating offense.

He is a life member of the National Association of Criminal Defense Lawyers and a life member of the New York State Association of Criminal Defense Lawyers.  In 1999, Mr. Wisner became a member of the National College for DUI Defense at Harvard Law School (the college was founded in 1995).  He is actively involved in its mission to defend those accused of alcohol influenced operating offenses

In 2002, Todd J.W. Wisner became one of the first lawyers in New York State to be Certified by the National Highway Traffic Safety Administration as an Administrator of Standardized Field Sobriety Testing.

In 2002, Wisner & Wisner LLP became the first New York law firm to own and maintain a functioning BAC Datamaster™ breath testing instrument.  The BAC Datamaster™ is the most widely used device by New York State law enforcement.  Wisner & Wisner LLP also acquired a Breathalyzer that year.

In 2002, Mr. Wisner founded NEWYORKDWI.COM.

In July of 2002, Mr. Wisner was asked to speak on DWI law by WHEC Channel 10 News in Rochester, N.Y. 

In 2003, Todd J.W. Wisner was the first New York lawyer to be factory trained in the Supervisor program of the BAC Datamaster™ by the manufacturer at National Patent Analytical Systems, Inc..  In addition, Mr. Wisner was Certified in the Science of Evidential Breath Alcohol Testing and as a Breath Test Operator of the BAC Datamaster™ in Mansfield, OH.

In 2003, Wisner & Wisner LLP was one of the first New York law firms to own a Alco-Sensor IV manufactured by Intoximeters, Inc.  The Alco-Sensor is the breath screening device most commonly used by the New York State Police , Monroe County Sheriff , and law enforcement throughout the state including the Rochester Police Department

December 13, 2005, Mr. Wisner was a featured DWI lawyer in the Democrat & Chronicle Newspaper.

In 2005, Todd J.W. Wisner became the first New York lawyer to be Certified by the National Highway Traffic Safety Administration (NHTSA) in the Instructor Development Training Program of DWI Detection and Standardized Field Sobriety Testing.

In 2007, Todd J.W. Wisner was the first New York lawyer to be twice trained at the factory on BAC Datamaster™ by the manufacturer at National Patent Analytical Systems, Inc.  In addition, Mr. Wisner is now certified to operate, perform diagnostic verifications, and calibrate the BAC Datamaster.

In 2007, Todd J.W. Wisner was the first New York lawyer to be factory trained on the Datamaster DMT ™ by the manufacturer at National Patent Analytical Systems, Inc.  The Datamaster DMT ™ will change the way breath testing is conducted in New York.  The Datamaster DMT ™ is expected to replace the BAC Datamaster™, the most widely used instrument in New York, in 2007.  The new instrument will allow operators to view the volume and analysis of a subjects breath in the form of a breath test graph.  It is portable and can analyze and record multiple breath tests of a subject.  The benefit to our clients of Mr. Wisner being the first New York lawyer to be certified in the operation and calibration of the Datamaster DMT ™ cannot be overstated.  Indeed, Mr. Wisner's training makes him more familiar with this instrument than most law enforcement officers, breath test operators, lawyers and judges.

October 14, 2007, Mr. Wisner was once again asked to comment on DWI jury trials in article Trials atypical in local DWI's from Rochester newspaper the Democrat & Chronicle.

November 18, 2009, Mr. Wisner was asked to comment on questionable traffic stops in The Daily Record, Western New York's legal daily newspaper.

December 24, 2009, Todd J.W. Wisner represents the first defendant charged under the new Leandra's Law in Rochester, New York.  The law was enacted on November 18, 2009.

December 31, 2009, Todd J.W. Wisner was asked to comment on the newly enacted Leandra's Law, converting a first offense DWI misdemeanor charge to a class E felony when a child is in the vehicle.  Wisner was also asked to comment on the amendment of the 1193 statute mandating use of the ignition interlock on all misdemeanor and felony DWI convictions.  The article was in The Daily Record, Western New York's legal daily newspaper.

August 15, 2010, DWI Lawyer Wisner was asked to comment on the newly enacted Leandra's Law imposing a mandatory ignition interlock device on all misdemeanor and felony DWI defendants.  See Democrat & Chronicle article Leandras Law aims to lock out DWI offenders.

Wisner & Wisner LLP maintains a library of maintenance, calibration and repair records of twenty four breath testing instruments used in Western New York.

Actively involved in contesting the DWI laws, Todd J.W. Wisner has challenged the constitutionality of the suspension pending prosecution statute; the calibration of the BAC Datamaster; and the admissibility of the Horizontal Gaze Nystagmus Standardized Field Sobriety Test.  Wisner & Wisner LLP is actively challenging not only the laws but how they are applied to the citzen accused.  The recent change in the blood alcohol level in New York to .08 BAC has raised new issues concerning the viability of the statute.

Mr. Wisner has represented individuals having a variety of careers including: college professors, airline pilots, college administrators, teachers, nurses, commercial drivers with CDL licenses, small business owners, corporate CEO's, military personnel, ROTC students, European foreign nationals, Canadian foreign nationals, hearing impaired drivers, police officers, and construction workers.

Mr. Wisner successfully tries cases in town courts, city courts as well as before New York's County and Supreme Courts.
