Wisner & Wisner, LLP, owns and maintains an operable and calibrated BAC Datamaster™ manufactured by the National Patent Analytical Systems, Inc.

This breath testing device is used by more law enforcement officials than any other in New York.  In Rochester, NY, the BAC Datamaster™ is the device of choice used by the Rochester Police Department, the Monroe County Sheriff as well as most town and village law enforcement agencies. 

The August 2002 acquisition placed Wisner & Wisner, LLP, as the first law firm in New York State to own a BAC Datamaster™. 

Wisner & Wisner, LLP also owns a RepCo Simulator.  This simulator is the same used by most law enforcement agencies in New York State to self check the BAC Datamaster to see if it is within acceptable tolerances.

In addition, Wisner & Wisner, LLP maintains a library of maintenance, calibration and repair records on four hundred twenty two breath testing instruments, including the BAC Datamaster™, used in New York State.  Our attorneys have been able to use this library to anticipate and spot problems with certain units used by law enforcement.

Todd J.W. Wisner is also factory trained in the Supervisor Program of the BAC Datamaster™ by the manufacturer.  Mr. Wisner was the first New York lawyer to be Certified in the Science of Evidential Breath Alcohol Testing and as a Breath Test Operator of the BAC Datamaster™ in Mansfield, OH, at National Patent Analytical Systems.

Owning a BAC Datamaster™ has allowed the firm to examine the device, check "verification" of the unit's "calibration" and simulate field use.  It has also allowed the Wisner & Wisner, LLP, to test subjects under circumstances similar to that in the field by law enforcement. 

 

Wisner & Wisner, LLP has also acquired parts of the BAC Datamaster to examine, test and compare with the parts of a functioning BAC Datamaster.

Owning a BAC Datamaster has allowed the firm to conduct independent testing with live subjects with varying degrees of alcohol consumption.  We have been able to test the accuracy of the unit when compared with other breath testing devices.  Further, the firm has been able to test the accuracy of the device when other factors are introduced to the equation other than alcohol.

 

Wisner & Wisner, LLP, also owns a Alco-Sensor IV manufactured by Intoximeters, Inc.  The Alco-Sensor is the breath screening device of choice by New York State law enforcement.  Police use the Alco-Sensor as a screening device to ascertain if a motorist has been drinking but is not evidentiary. This device is widely used by New York police because, unlike the BAC Datamaster, it is hand held and portable.  Our particular model is used in California for evidentiary purposes. 

Wisner & Wisner, LLP, holds the distinction of being one of two New York law firms to have an Alco-Sensor.

   
 
  Wisner & Wisner, LLP, also owns a Breathalyzer Model 900A manufactured by the Stephenson Corporation.  The Breathalyzer was used for years as the breath screening device of choice by New York State law enforcement  It continues to be used as a backup when the BAC Datamaster™ is not functioning properly or is used in rural townships. The unit has otherwise been retired from use by most law enforcement agencies.
