Todd J.W. Wisner asked to comment in the legal publication The Daily Record on the People v. Hernandez case where Mr. Wisner represented Mr. Hernandez in a DWI case where the court suppressed the chemical breath test based upon the use of electronic signatures on the basis that they were not reliable and deprived the defendant of the right to confront the evidence. Mr. Wisner's argument and the court's reasoning was confirmed in an unrelated United States Supreme Court case Bullcoming v. New Mexico, 564 U.S. _____ (2011).

Todd J.W. Wisner became the first New York lawyer to be certified in the science of evidential breath alcohol testing and the operation of the BAC Datamaster® at National Patent Analytical Systems.

WISNER & WISNER adopts two highways in Monroe County to clean and maintain through the Monroe County Department of Transportation. The highways are cleaned several times a year by attorneys and staff. The law firm has continued to maintain these highways until present.
AUGUST 2002
WISNER & WISNER acquires a BAC Datamater ® and becomes the first New York law firm to own the newer breath testing instrument from National Patent Analytical Systems. This is the same breath testing instrument used in the STAR van by the Monroe County Sheriff's Department, the Rochester Police Department and by most law enforcement agencies. WISNER & WISNER also acquired a RepCo Simulator which is used by law enforcement to simulate a breath test before and after a subject blows into the Datamaster to check to see if the device has fallen out of industry standards.

Mr. Wisner became one of the first lawyers in New York State to be certified in the administration of standardized field sobriety testing.

WISNER & WISNER acquires a ALCO-SENSOR IV preliminary breath screening device manufactured by Intoximeters, Inc. The Alco-Sensor is widely used by law enforcement because it is hand held and portable. The device is known to be used by the New York State Police, the Monroe County Sheriff, the Rochester Police Department and other law enforcement agencies in sobriety checkpoints and at road side stops. WISNER & WISNER's model IV allows the device to save a result into memory and print the result.

WISNER & WISNER begins fundraising for Camp Good Days & Special Times, Inc. The law firm begins a annual campaign to raise money for the camp. Both Donald Wisner and Todd Wisner volunteered at the camp when Todd was in college.

WISNER & WISNER acquires a BREATHALYZER MODEL 900A manufactured by the Stephenson Corporation. The Breathalyzer was used by law enforcement statewide for many years until the 1980's when the New York State Troopers adopted the Draeger Alcotest and the Monroe County Sheriff's Department and other most other law enforcement agencies adopted the BAC Datamaster®. Often police, prosecutors and some judges still refer to the newer breath testing devices as the breathalyzer. Today the device is considered an antique.
